Neither the price nor the timetable is set by a seller or an agent: the Master fixes both, at the end of a process governed by strict statutory deadlines running from the seizure of the property to its adjudication to the highest bidder. Where the debtor does not contest it, the full chain typically takes several months to close to a year.<\/p>\n<h2>What a sale by levy actually is<\/h2>\n<p>A sale by levy happens when a creditor \u2014 usually a bank, sometimes a private creditor holding a judgment \u2014 has a debtor&#8217;s property seized to recover what is owed from its forced sale. It differs from an ordinary purchase in two ways. First, the buyer signs no preliminary agreement and no standard notarial deed: title rests on the memorandum of charges (the court&#8217;s conditions of sale) and the judgment of adjudication that declares the buyer the purchaser. Second, there is no negotiated viewing period and none of the due diligence a buyer normally gets through <a href=\"https:\/\/real-estate-mauritius.mu\/en\/notary-property-purchase-mauritius\/\">the notary&#8217;s role in an ordinary purchase<\/a>: the property is sold as described in the memorandum of charges filed with the court, as is.<\/p>\n<h2>From seizure to the reading of the conditions of sale<\/h2>\n<p>Before a property reaches auction, it goes through a sequence of steps whose deadlines are set by statute, not negotiated by the parties. The creditor must first have a formal demand \u2014 a <em>commandement<\/em> \u2014 served on the debtor in person; seizure can only take place ten days after that service, and if the creditor lets more than ninety days pass without seizing, a fresh demand must be served. Once seizure has taken place, it is registered at the Mortgage Office, and the debtor, any registered creditors and an unpaid vendor, if there is one, are each notified in turn. The pursuing creditor sets a reserve price, which by law cannot be less than half the open market value of the property as assessed by an independent valuer appointed by the creditor at the time the seizure was registered. If no bid exceeds that reserve, the property is adjudicated to the creditor itself. The Master can also postpone the sale on being satisfied that the highest bid is well below the property&#8217;s value, or that a postponement would reasonably produce a better price. This is why a property sold by levy can, in some cases, go for less than its open-market value \u2014 though that only means something if you can check it against a reliable benchmark, such as the market figures Westimmo publishes on <a href=\"https:\/\/real-estate-mauritius.mu\/en\/property-prices-mauritius\/\">property prices in Mauritius<\/a>.<\/p>\n<p>The law bars certain people from bidding: the Master and staff of his office (unless specially authorised by the Attorney-General), the debtor whose property is being sold, the debtor&#8217;s guardian or curator, the attorney handling the sale, and anyone known to be insolvent. A bid made on behalf of any of them is void, and exposes whoever made it to a claim for damages.<\/p>\n<h2>What the successful bidder must pay within 20 days<\/h2>\n<p>The Master will not hand over the title deed until the purchaser has deposited the taxed costs of sale and the duty payable on registration and transcription, and has proved that every condition in the memorandum of charges has been met. That deposit is due within twenty days of the adjudication; miss it, and the purchaser becomes liable to a forced resale at their own cost and risk. This short window makes ordinary bank financing difficult to line up in time: a buyer relying on <a href=\"https:\/\/real-estate-mauritius.mu\/en\/borrowing-mauritius-foreign-buyer-guide\/\">a mortgage in Mauritius<\/a> needs pre-approval, or the funds themselves, arranged well before the bidding starts.<\/p>\n<h2>What ownership actually transfers<\/h2>\n<p>The judgment of adjudication transfers to the buyer only the rights the debtor actually held over the property, no more. Registered creditors are not paid off by the buyer at the time of sale; they are paid out of the sale price itself, through a court-supervised distribution process, after which their mortgage inscriptions are struck off the register. That is a different mechanism from a standard purchase, where it is the notary who negotiates the release of any mortgage before <a href=\"https:\/\/real-estate-mauritius.mu\/en\/stamp-duty-notary-fees-mauritius\/\">the deed is signed and the registration duty settled<\/a>; here, the discharge follows directly from the court process. One more thing to plan for: if someone is still physically occupying the property and refuses to leave, the buyer has to obtain possession through the proper legal channels \u2014 potentially a separate court step, not simply a handover of keys.<\/p>\n<h2>Can a non-citizen buy at a sale by levy in Mauritius<\/h2>\n<p>The Sale of Immovable Property Act itself does not bar non-citizens from bidding: the list of people who cannot buy, set out above, makes no reference to nationality. But a separate law applies alongside it. The Non-Citizens (Property Restriction) Act requires any non-citizen who wishes to &#8220;hold, purchase or otherwise acquire&#8221; property in Mauritius to obtain written authorisation beforehand, issued by the Ministry responsible for internal affairs or by the Economic Development Board, depending on the case. That requirement applies whatever the method of acquisition, including an adjudication: the Act only exempts specific categories \u2014 property acquired by a spouse married under the legal community-of-property regime, by inheritance, or by the effect of marriage; listed company shares; property for business use authorised by the EDB; an apartment worth at least Rs 6 million in a building of at least two floors above ground; or a residential unit bought from a company holding an IRS, RES or PDS certificate.<\/p>\n<p>In practice, this means a non-citizen can only bid freely if the seized property already falls into one of these approved categories \u2014 a unit sold by a company holding a PDS, IRS or RES certificate, for instance, remains eligible on the same terms as <a href=\"https:\/\/real-estate-mauritius.mu\/en\/irs-res-pds-resale-mauritius\/\">an ordinary IRS, RES or PDS resale<\/a>. For any other property, authorisation has to be obtained before the adjudication \u2014 a step that is hard to reconcile with the auction&#8217;s tight publication schedule unless it has been arranged months in advance.
