{"id":332224,"date":"2026-09-28T18:10:25","date_gmt":"2026-09-28T14:10:25","guid":{"rendered":"https:\/\/real-estate-mauritius.mu\/?p=332224"},"modified":"2026-09-28T18:13:45","modified_gmt":"2026-09-28T14:13:45","slug":"unpaid-rent-mauritius-landlord-recourse","status":"publish","type":"post","link":"https:\/\/real-estate-mauritius.mu\/en\/unpaid-rent-mauritius-landlord-recourse\/","title":{"rendered":"Unpaid Rent in Mauritius: A Landlord&#8217;s Legal Recourse, From Notice to Eviction"},"content":{"rendered":"<p>A tenant who stops paying rent in Mauritius can never be put out by the landlord alone: the final decision always rests with a court, whether the property is let furnished or unfurnished. What changes, and changes the whole procedure, is which law applies. Unfurnished lettings fall under the Landlord and Tenant Act 1999; furnished lettings \u2014 the majority of the stock rented out to expatriates and foreign investors \u2014 fall under ordinary contract law. Here is what a landlord can actually do, step by step, once rent stops coming in.<\/p>\n<h2>Two different legal regimes, depending on whether the letting is furnished<\/h2>\n<p>The Landlord and Tenant Act applies in principle to any let premises in Mauritius. But section 3 explicitly excludes premises let furnished, or where the rent includes furniture, board and attendance, or equipment, as well as business premises let after 1 July 2005. In practice, almost every furnished villa or apartment let to an expatriate or as a rental investment falls outside this special law and the stronger tenant protection it grants.<\/p>\n<p>For furnished lets, the dispute is handled under the general contract provisions of the Mauritian Civil Code: there is no Fair Rent Tribunal with jurisdiction, and no &#8220;protected tenant&#8221; status. Unpaid rent is treated like any other breach of contract, and it is the ordinary civil court, depending on the amount claimed, that decides.<\/p>\n<p>For unfurnished lettings that remain within the Act, section 17 lists rent lawfully due and unpaid among the grounds on which the court may order the landlord back into possession, alongside any other breach of the tenancy&#8217;s obligations.<\/p>\n<h2>The formal notice: the starting point, before any court action<\/h2>\n<p>Mauritian law sets no fixed statutory delay before a landlord can bring a claim for unpaid rent, unlike the &#8220;commandement de payer&#8221; mechanism in French law. Skipping this step is still risky: for lettings covered by the Landlord and Tenant Act, the court may only order possession if it considers the measure reasonable, and it looks in particular at whether the landlord warned the tenant in writing and gave a fair chance to catch up. The same duty of good faith applies to a furnished letting judged under ordinary contract law.<\/p>\n<p>In practice, a dated letter or email of formal notice, sent by registered post or handed over against a receipt and setting a reasonable payment deadline, is the first document of the file. It should be accompanied by proof of non-payment: bank statements, or the rent book that every landlord covered by the Landlord and Tenant Act must keep up to date under section 5.<\/p>\n<h2>Bringing the claim before the right court<\/h2>\n<p>For a letting under the Landlord and Tenant Act, section 32 gives the District Court exclusive jurisdiction to hear any matter arising under that Act, including a claim for unpaid rent.<\/p>\n<p>For a furnished letting, judged under ordinary law, the competent court depends on the amount claimed. Mauritian law firms currently put the District Court&#8217;s civil jurisdiction at up to Rs 250,000, the Intermediate Court&#8217;s at up to Rs 2 million, with the Supreme Court alone competent above that. For an ordinary residential rent arrears claim, the case will most often sit with the District Court.<\/p>\n<p>Either way, the procedure follows the same pattern: a plaint is lodged at the registry, then a summons is served on the tenant under the rules of the District and Intermediate Courts (Civil Jurisdiction) Act. The court sets a hearing date, hears both sides, and rules.<\/p>\n<p>For a letting under the Landlord and Tenant Act, section 27 allows the court to adjourn the case and set conditions for payment of the arrears before deciding on possession: a tenant who resumes payments during the proceedings can therefore avoid eviction, even after being summoned. A decision can be appealed to the Supreme Court.<\/p>\n<h2>Enforcement: a court decision, never self-help repossession<\/h2>\n<p>Changing the locks, cutting off water or electricity, or removing a tenant&#8217;s belongings to force them out is not a lawful route in Mauritius, whatever the letting&#8217;s legal regime. Section 16 of the Landlord and Tenant Act is explicit: no possession order can be obtained other than through the court, and the same logic applies just as fully to a furnished letting under ordinary law, where only a court judgment, followed by its formal execution, allows the landlord to take the property back.<\/p>\n<p>Once judgment is obtained, it is enforced by an usher, the enforcement officer of the Mauritian courts. For a money judgment covering the rent owed, the District and Intermediate Courts (Civil Jurisdiction) Act lets the court issue a warrant of execution against the tenant&#8217;s movable property if the judgment remains unpaid. For recovering the premises themselves, Mauritian court practice refers to this step by its own name, a writ of habere facias possessionem, which authorises the usher to put the landlord back in possession.<\/p>\n<h2>Reducing the risk before it materialises<\/h2>\n<p>A security deposit taken at signature can be set against unpaid rent, but it rarely covers more than a few weeks to a few months, and it never removes the need to pursue the balance formally.
