{"id":333300,"date":"2026-10-03T14:08:20","date_gmt":"2026-10-03T10:08:20","guid":{"rendered":"https:\/\/real-estate-mauritius.mu\/?p=333300"},"modified":"2026-10-03T14:11:04","modified_gmt":"2026-10-03T10:11:04","slug":"buying-existing-house-mauritius-permit-occupation-certificate","status":"publish","type":"post","link":"https:\/\/real-estate-mauritius.mu\/en\/buying-existing-house-mauritius-permit-occupation-certificate\/","title":{"rendered":"Buying an Existing House in Mauritius: Building Permit, Occupation Certificate and Extensions"},"content":{"rendered":"<p>Before you buy a house that is already built in Mauritius, ask the seller for three documents: the Building and Land Use Permit (BLP) with its approved plans, the occupation certificate issued by the local authority, and, for a house of 150 m\u00b2 or more, the clearance certificate signed by the architect or engineer who supervised the works. Then compare the plans with the house itself. An extension, an extra floor or an outbuilding that is not in the permit is an offence by whoever built it, punishable by a fine of Rs 100,000 to Rs 500,000 and an order to pull it down at their own cost.<\/p>\n<h2>The three documents to ask for<\/h2>\n<h3>The permit (BLP) and the approved plans<\/h3>\n<p>Under section 117 of the Local Government Act 2011, nobody may undertake development works without a permit. The Act counts as development works the building, extension or demolition of a building, its alteration or repair, a material change in how a building is used, the division of land, and the site preparation and excavation that go with these works. Applications go online to the District Council or Municipal Council for the area, through the National Electronic Licensing System.<\/p>\n<p>For a buyer, the approved plans are what matter. They record what the council allowed: floor areas, levels and position on the plot. A permit does not stay valid indefinitely if it is not used. It lapses after 3 years unless the works have reached a set stage, for example external walls raised to 600 mm above the floor slab. For an existing house, ask for the date of the permit as well, and for proof that the house was actually built under it.<\/p>\n<h3>The occupation certificate<\/h3>\n<p>A building erected under a BLP may not be lived in until the council that issued the permit has issued an Occupation Certificate (section 120C). The permit holder applies for it once the works are finished. The council must issue it within 5 working days if the permit has been followed and, where one is due, the compulsory insurance premium has been paid. Letting a building be occupied without the certificate carries a fine of Rs 10,000 to Rs 50,000, and the date on the certificate counts as the date occupation began.<\/p>\n<p>You will sometimes see this called a &#8220;compliance certificate&#8221;. The official permit guide still refers to the old section 19 of the Building Control Act, which was repealed in 2018. The rule now is section 120C of the Local Government Act. The Act also allows regulations to exempt certain buildings from the certificate, so if the seller has none, ask why rather than assume.<\/p>\n<h3>The architect&#8217;s or engineer&#8217;s certificate, from 150 m\u00b2<\/h3>\n<p>For a building with a floor area of 150 m\u00b2 or more, the application for an occupation certificate must come with a clearance certificate. The principal agent, meaning the architect or engineer appointed to supervise the works, issues it to confirm that the building was erected in line with the permit. Without it, a large house cannot get its occupation certificate. It should be in the papers of the seller or the builder.<\/p>\n<h2>Extensions: what needs a permit and what does not<\/h2>\n<p>Inside the house the rule is more relaxed than many people expect. Maintenance, improvement or alteration that affects only the interior, or that does not materially change the outside appearance, is not &#8220;development works&#8221; under the Act. Fitting a new kitchen or moving a partition wall therefore needs no permit.<\/p>\n<p>Anything that adds to the building or can be seen from outside does need one: an enclosed veranda, an extra floor, a garage, a studio at the bottom of the garden, an enlargement. The permit guide adds that for a horizontal or vertical extension, the file must include the plans of the existing structure as well as those of the extension. An extension built after the house falls under its own permit, and section 120C speaks of &#8220;a building or part of a building&#8221;, so the certificate for the original house does not on its own cover what was added later.<\/p>\n<p>To check, walk the property with the plans in your hand. Measure the rooms, count the levels and look for anything newer than the rest, such as different materials, a different roof or visible joins. Settle any difference before the deed is signed, not after.<\/p>\n<h2>What the owner of a non-compliant building risks<\/h2>\n<p>The law targets first of all the person who carried out the works. Anyone who builds without a permit, or who departs from the one they hold, commits an offence punishable by a fine of Rs 100,000 to Rs 500,000. The court also orders the works to be pulled down within 30 days at the offender&#8217;s expense. If they are not, the council pulls them down and recovers the cost.<\/p>\n<p>Before that point the council has to serve a notice. For works carried out without a permit it is a compliance notice, which allows at most 30 days to apply for one. If the application is approved, the permit is issued only once a penalty of Rs 50,000 has been paid on top of the permit fee, within 28 days of notification. If no application is made, or the penalty is not paid, the council serves a pulling down notice, to be carried out within 30 days at most. For works that depart from the permit, an enforcement notice sets out the measures to take, including demolition, within 30 days at most. Regularisation is therefore possible, but approval of the application is not guaranteed.<\/p>\n<p>This system of notices and fines covers only works undertaken after the section came into force, a section added to the Act in 2018. Older works fall outside it, so ask the notary which regime applies to the house you are looking at.<\/p>\n<p>The text does not say what happens to a buyer when a non-compliant building changes hands, because the notices and prosecutions are aimed at &#8220;the person undertaking the development works&#8221;. Do not count on that silence to protect you. A house whose extension has to be regularised or demolished will cost you money and time whoever committed the offence, and your own future buyer will ask the same questions.<\/p>\n<h2>Before you sign: documents, clauses and guarantees<\/h2>\n<p>Ask the seller in writing for a copy of the BLP and the approved plans, the occupation certificate, the architect&#8217;s or engineer&#8217;s certificate if the house is 150 m\u00b2 or more, and the permit for each extension. Ask also whether the council has sent any notice (compliance, enforcement or pulling down). Whether the building complies is something you ask the seller and the council on top of that.<\/p>\n<p>For a recent house, ask about insurance as well. For buildings set by regulation, the Building Control Act provides a 10-year policy covering structural elements (foundations, beams, load-bearing walls) for the benefit of successive buyers, and a 2-year policy for non-structural elements. Ask whether a policy exists for the house. And if you doubt its soundness, a survey by an architect or engineer before you buy costs little next to the price.<\/p>\n<h2>After the purchase: your own works<\/h2>\n<p>The same rules apply to you once you own the house: no veranda, extra floor or other permanent structure without a permit.
